ORDER

The Writ Petition has been filed seeking orders to forbear the respondents from interfering with the writ petitioner's peaceful running of his eatery shop in the name of Famous Jigarthanda functioning at 17, Fruit Market Complex, Mattuthavani, Melur Main Road, Madurai during late night hours.

2. Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. The learned counsel appearing for the writ petitioner would submit that the writ petitioner has been running a hotel in the name of Famous Jigarthanda at Fruit Market Complex, Mattuthavani, that the respondent police has been threatening the writ petitioner to close the shop at 10.00 p.m. and that therefore the writ petitioner was constrained to file the present petition.

4. The learned Additional Public Prosecutor appearing for the 2/4

respondents would submit that they have not directed them to close the shop at 10.00 p.m. and they only regulated the traffic in that area.

5. Since the learned Additional Public Prosecutor submitted that they have neither threatened nor directed the writ petitioner to close the shop at 10.00 p.m., the question of issuing direction to the respondents does not arise at all. Hence, the Writ Petition stands disposed of. No costs.
