Respondents PRAYER:Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order in Mu.Mu.B1/18428/2014 on the file of respondent No.2 dated 30.05.2015 and quash the same as illegal and consequently direct the Respondents 2 and 3 to grant patta to the petitioner land in Survey No.563, Karaikudi Taluk, Karaikudi, Sivagangai District to an extent of 40 cents.

ORDER

When the matter is taken up for hearing today, the learned counsel appearing for the petitioner would fairly concede that there are factual controversies, which cannot be resolved by this https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.16536 of 2016 Court in exercising its extraordinary jurisdiction under Article 226 of the Constitution of India. Therefore, he seeks permission of this Court to withdraw this Writ Petition and to workout her remedies before the competent civil Court.

2.In view of the above submission of the learned counsel for the petitioner, this Writ Petition stands dismissed as withdrawn with liberty to the petitioner to approach the competent legal forum, if she is so advised. No costs. Consequently, connected miscellaneous petition is closed.
