Pleased to call for the records and set aside the impugned order of taking cognizance dated 13.09.2019 the charge sheet filed in STC No. 1692 of 2019 on the file of the Judicial Magistrate, Nilakottai.
Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.MAYILVAHANA RAJENDRAN.C, Advocate for the petitioner and of MR.S.MANIKANDAN, Government Advocate on behalf of the 1st Respondent and of MR.C.SARAVANAKUMAR, Advocate for the 2nd Respondent and the Respondents 3 to 5 are not appearing either in person or by an advocate, the court made the following order:- This Petition is filed to condone the delay of 648 days in filing the Criminal Revision Case before this Court.
2. The learned counsel for the petitioner, Mr.S.Manikandan, learned Government Advocate (Crl.Side) appearing for the first respondent and learned 2/5
counsel for the second respondent are present before this Court. The respondents 3, 4 and 5 names are printed in the cause list.
3. Mr.S.Manikandan, learned Government Advocate (Crl.Side) appearing for the first respondent and the learned counsel for the second respondent have raised the formal objections.
4. Heard the learned counsel appearing for the petitioner and the learned counsel for the respondents 1 and 2 and also perused the materials placed before this Court.
5. Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 648 days in filing the Criminal Revision Case is condoned on payment of costs of Rs.1,000/- (Rupees One Thousand only) to the credit of District Siddha Medical Officer, CCRI, Periyakulam (A/c.No.10767823177, IFSC Code:SBIN0000898, State Bank of India, Periyakulam Branch) and to pay a sum of Rs.1,000/-(Rupees One Thousand only), by the petitioner to the second respondent within a period of two weeks from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically without further reference to this Court. Accordingly, this Criminal Miscellaneous Petition is allowed. 3/5
6. If the amount paid within a time stipulated by this Court, Registry is directed to number the Criminal Revision case, if it is otherwise in order and list the same for admission.
