O RDER This petition has been filed seeking to quash the FIR in Crime No.06 of 2022 on the file of the first respondent. 2.The case of the prosecution is that the petitioners are in-laws of the second respondent/defacto complainant. There was a dispute between the second respondent and the first petitioner, who is the mother-in-law of the second respondent. The second respondent made a complaint before the first respondent police on 08.04.2022 and the same was registered in Crime No.06 of 2022 against the petitioners for the offence under Sections 406 and 498(A) of IPC. Challenging the same, the petitioners have filed the present petition before this Court. 3.
The learned counsel for the petitioners would submit that the first petitioner has already lodged a complaint before the T-2, Ambattur Estate Police Station, Ambattur, Thiruvallur District and the same was registered in Crime No.305 of 2022 against the second respondent and her brother for the alleged offences under Sections 465, 468 and 471 of IPC. Against which, they have filed a petition in Crl.O.P.No.3791 of 2024 before this Court and the same was allowed on 21.02.2024 on the ground that the parties were entered into compromise between them.
order to avail the very same benefit, the petitioners have filed the present petition before this Court.
4.The learned Government Advocate (Crl. side) for the first respondent and the learned counsel for the second respondent did not dispute the said facts submitted by the learned counsel for the petitioners and they have no serious objections for allowing this petition. 5.This Court, in Crl.O.P.No.3791 of 2024, dated 21.02.2024, while quashing the FIR in Crime No.305 of 2022, has specifically observed that, "6.By virtue of quashing the FIR in this case, the petitioners have also agreed that they will co-operate for the quashing of the FIR that has been challenged before the Madurai Bench of this Court and pending in Crl.OP.Md.No. 18930 of 2022, on the ground of compromise."
6.In view of the above facts and circumstances of the case, the matter was already compromised between the parties and the second respondent also admitted the compromise in favour of the petitioners/A1 to A3 and the same was also part and parcel of this Court order in Crl.O.PNo.3791 of 2024, dated 21.02.2024. Hence, this Court is inclined 3/5
to quash the FIR in Crime No.06 of 2022 in respect of the petitioners/A1 to A3.
7.Accordingly, FIR in Crime No.06 of 2022 on the file of the first respondent police, is hereby quashed in respect of the petitioners/A1 to A3 and this Criminal Original Petition is allowed. Consequently, connected miscellaneous petition is closed.
