(The first respondent is the guardian and mother of the respondents 3 & 4) This case came up for settlement before the Lok Adalat. After mutual discussion, negotiation, mediation and conciliation between both parties and with the assistance of the Bench, both sides consented for settlement.
AWARD The appellant is the Insurance Company. Aggrieved by the compensation awarded by the Tribunal to the tune of Rs.14,63,208/- together with 7.5% interest per annum.
Today, the appellant Insurance Company represented by its Standing counsel Mr.C.Karthik is present. The claimants are also present along with their counsel. The parties have amicably resolved to fix the compensation of Rs.13,83,208/- with 7.5% interest. It is brought to our notice that pending the appeal, all the minors have attained the age of majority. The appellant /Insurance Company has already deposited the entire compensation amount with interest before the Tribunal. The appellant/ Insurance Company is permitted to withdraw Rs.80,000/- with proportionate interest, which they have already deposited in the Court. The remaining amount, if any, with proportionate interest shall be withdrawn by the fourth respondent herein, namely Vigneswaran, for which, the other respondents have agreed.
The court fee paid shall be refunded to the parties in the manner provided under the Court Fees Act 1870 as provided for under Sub Section 1 of Section 21 of the LSA Act, 1987, as amended in 1994.
The original of the award shall be placed in the Court record and copy of the award shall be kept with the High Court Legal Service Committee and one copy each is furnished to both parties free of cost.
In agreement of the above, both parties and their counsel have affixed their signatures/Thumb impressions in presence of the Lok Adalat Bench admitting the terms and conditions and accordingly, the award is passed.
