Respondent / Respondent Prayer: This Civil Miscellaneous Appeal is filed under Section 55 of Indian Divorce Act, 1869, to set aside the order and decreetal order dated 27.07.2016 made in D.O.P.No.342 of 2011, on the file of the learned District Judge, Kanniyakumari at Nagercoil. JUDGMENT

It is seen that as agreed by the learned counsel, the appellant husband deposited a sum of Rs.2,70,000/- (Rupees Two Lakhs and Seventy Thousand only) in M.C.No.277 of 2011, before the Family Court, Thiruvananthapuram and he has deposited a sum of Rs.10,000/- (Rupees Ten Thousand only) towards litigation charges in I.D.O.P.No.342 of 2011, on the file of the learned District Judge, Kanyakumari. The respondent wife is permitted to withdraw a sum of Rs.10,000/- (Rupees Ten Thousand only) before the District Court, Nagercoil, which was deposited by the appellant. 2.In view of the same, the order passed by the learned District Judge, Nagercoil in I.D.O.P.No.342 of 2011 dated 27.07.2016 is set aside and the case is remitted back to the District Court for disposal in accordance of law. The learned District Judge, Nagercoil is hereby directed to dispose of the case within a period of three months from the date of receipt of copy of this order. Both the parties are directed to cooperate with the trial.
