PRAYER :- For Bail in Crime No.417/2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Accused No.4 herein, who was arrested on 30.08.2023 for the alleged offence under Sections 294(b), 323, 307 and 506(ii) of IPC, in Crime No.417 of 2023, on the file of the respondent police, seeks bail. 1/4
2.The case of the prosecution is that on 28.08.2023 at about 07.30 p.m., when the defacto complainant was returning to his home, one Prakash came that way and dashed against him. When the same was questioned, the above said Prakash, along with other accused gathered, tried to assault with iron rod and caused severe injuries. Hence, the complaint.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution. It is a case in counter case.
4.The learned Additional Public Prosecutor submitted that it is a case in counter case. The injured in this case has been discharged from the hospital. The matter has been settled out of the court between the parties, in the presence of the elders. 5.Considering the fact that it is a case in counter case, in both the cases the injured have been discharged from the hospital and the matter has been settled between the parties out of the Court, this Court is inclined to grant bail to the petitioner with certain conditions.

6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.V, Tirunelveli, and on further condition that the petitioner shall report before the respondent police as and when required for interrogation.
