For Respondent : Mr.B.NAMBISELVAN, Additional Public Prosecutor For Intervenor : M/s.R.VENNILA, Advocate PETITION FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- For Bail in Crime No.16/2023 on the file of the respondent polic ORDER : The Court made the following order :- The petitioner/Accused, was arrested and remanded to judicial custody on 28.07.2023, for the alleged offence punishable under Sections 120(b), 406, 420, 468 and 471 of IPC in Crime No. 16 of 2023, on the file of the respondent police, seeks bail. 1/3

2. The case of the prosecution is that the accused persons approached the defacto complainant promising to secure a Central Government job and received a sum of Rs.7,50,000/- through his bank account. Later, he failed to get job and also the accused has not returned the money. Hence the complaint.

3. Learned counsel for the petitioner would submit that the petitioner is an innocent, he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case.

4. Learned Additional Public Prosecutor would submit that as on date there are 29 victims are there and more than Rs.3 Crores have been collected. The petitioner herein received the amount and transferred to the account of the first accused. The first accused is in custody. No amount was recovered. It is also submitted that the petitioner is also involved in creating documents the seal of the Central Government. Based upon the complaint, a search was made in the house and some documents have been recovered. The petitioner is involved in four previous cases in similar nature. Prima facie materials have been collected during the course of investigation to implicate the petitioner.

5. Considering the facts and circumstances of this case, this Court is not inclined to entertain this petition. I find no reason to grant relief to the petitioners herein.
