Writ Petitions filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus calling for the records relating to the impugned seniority list in the post of Junior Engineer for promotion to the post of Assistant Executive Engineer, issued by the first respondent in his proceedings Ma.Ne.2/32446/2014 dated 13.11.2014 and quash the same insofar as placing the 2nd respondent at Sl.No.1 in the seniority list and consequently directing the 1st respondent to treat the petitioner as senior to the 2nd respondent. 1/4

O R D E R

The writ petition has been filed against the impugned final seniority list dated 13.11.2014, published by the first respondent for the year 2014 - 2015, alleging the placement of the second respondent herein in Serial No.1 in the seniority list and for a consequential direction to the first respondent to treat the writ petitioner as a senior to the second respondent.

2. When the matter is taken up for hearing, the learned Counsel for the petitioner submits that since the subsequent seniority list was issued for the year 2017 - 2018, the aforesaid final seniority list dated 13.11.2014 does not survive.

3. Recording the said submissions of the learned counsel for the petitioner, this writ petition is dismissed as having become infructuous. No costs. Consequently, the connected miscellaneous petition is closed.
