PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order passed by the 3rd respondent in Pa.Mu.No.1742/2024/H, dated 23.07.2024 and quash the same as illegal and consequently, to direct the 1st respondent to dispose of the petitioner's appeal dated 26.08.2024 pending on the file of the 1st respondent. ORDER
By consent of both parties this Writ Petition is taken up for final disposal at the stage of admission itself.
2.Challenge has been made to the order passed by the 3rd respondent dated 23.07.2024 under Section 23 of Maintenance and Welfare of the Parents and Senior Citizens Act, directing the petitioner to vacate the premises. Further direction is also sought for, directing the 1st respondent to dispose of the appeal dated 26.08.2024 filed by the petitioner against the order of the 3rd respondent. 2/4
3.Considering the fact that the petitioner has already filed an appeal before the 1st respondent, challenging the order impugned herein, I direct the 1st respondent to dispose of the appeal dated 26.08.2024 within a period of one month from the date of receipt of a copy of this order. 4.With the above direction, this Writ Petition is disposed of.
