The Writ Petition is filed seeking a direction to the first respondent to dispose of the appeal filed by the Petitioner, dated 7.5.2025 seeking cancellation of Patta No.53, issued in the name of second respondent in respect of the property in S.NO.429/10, Mangiri Sukkanendal Village, Patharakudi, Karaikudi Taluk, 2.Mrs.K.Malathi, learned Additional Government Pleader takes notice for the respondents 1 and 2. By consent of both parties,the Writ Petition is taken up for final disposal at the admission stage itself.
3.The Petitioner claims right over the subject property under settlement deed executed by his father, dated 22.5.1967. According to the Petitioner, the second respondent obtained patta for 1.49 ares of land in S.No.429/10 without notice to the Petitioner. Hence the Petitioner submitted an appeal before the first respondent on 22.7.2024 seeking cancellation of patta issued in the name of second respondent. The same has not been considered so far. Hence the Petitioner is before this Court with the present Writ Petition for the relief stated supra.

4.Mrs.K.Malathi, learned Additional Government Pleader who takes notice for the respondents 1 and 2 would submit that the appeal filed by the Petitioner will be considered on its own merits within the time stipulated by this Court. 5.In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the appeal filed by the Petitioner, dated 07.05.2025 and pass final orders on its own merits after affording reasonable opportunity to the Petitioner and third respondent, within a period of 12 weeks from the date of a copy of this order.
6.With the above directions, the Writ Petition stands disposed of. No costs.
