PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 3rd respondent to restore the water service connection to the house (Door No.2/477) of the petitioner situated in S.No.839/11 of Vennavalkudi Village, Alangudi Taluk and Pudukkottai District at once. By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself.

2. The writ petition has been filed for a mandamus directing the 3rd respondent to restore the water service connection to the house (Door No.2/477) of the petitioner situated in S.No.839/11 of Vennavalkudi Village, Alangudi Taluk and Pudukkottai District at once.

3. It is the case of the petitioner that he is given water connection in S.No.839/11 of Vennavalkudi Village, Alangudi Taluk and Pudukkottai District. However, some amount has been demanded by the 2/5

5th respondent, which has not been made and hence, the water connection has been disconnected and hence, seeks the aforesaid prayer.

The learned Additional Government Pleader, on instructions, would submit that the petitioner is not residing in the village and though water connection was provided for domestic purpose, the same has been used for agricultural purpose and since the villagers are objecting to the same, it has been disconnected. However, he would submit that if the petitioner gives an undertaking that he will use the water connection for domestic purpose, the connection will be restored.

5. I have considered the rival submissions and perused the materials available on record.

6. In view of the said submission, the petitioner shall give an undertaking before the respondents 3 and 4 that he will use the water connection only for domestic purpose and on such undertaking, the water connection shall be restored within a period one week from the date of such undertaking.

7. The writ petition is disposed of with the above direction. No costs. Consequently connected Miscellaneous Petition is closed. 26.09.2024 RR TO
