Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to take into account service rendered by the petitioner in State Resource Centre, for pensionary benefits along with the petitioner's service as Professor in the 5th respondent University. ORDER

The Petitioner has come out with the present writ petition for a direction to the respondents to take into account the service rendered by the petitioner in State Resource Centre, for pensionary benefits along with the petitioner's service as Professor in the 5th respondent University.

2. Mr.S.Dhayalan, learned Government Advocate takes notice on behalf of the respondents 1 to 3. By consent of parties, this Writ Petition is taken up for final disposal at the stage of admission itself.

3. According to the petitioner, he was appointed as Research Assistant in State Research Centre for adult and Non-Formal Education, Chennai on 02.05.1983 and he was promoted as Associate Co-ordinator and Director. Thereafter, the petitioner was appointed as Assistant Professor in 5th respondent's University on 04.03.2013 and retired from service on 30.06.2018, on attaining the age of superannuation. Now, the petitioner is drawing a meager sum of Rs.1600/- as pension under EPF Scheme. The similarly placed persons who have joined as Associate Professor in various Universities and were working as Associate Co-ordinator and HOD., were granted with pensionary benefits by taking into account their service in the State Resource Centre. The petitioner is also entitled for the same. Therefore, on 10.05.

2019, the petitioner has sent a representation, which was not considered by the respondents. Hence, the petitioner has come up with the present Writ Petition. 4.The learned counsel for the petitioner submitted that it would suffice, if a direction is issued to the respondents to consider the representation of the petitioner, dated 10.05.2019 on merits.

5.Considering the nature of relief sought for by the petitioner, without deciding the issue on merits, the respondents are directed to consider the representation of the petitioner dated 10.05.2019 and pass orders on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6.With the above direction, this Writ Petition stands disposed of. No costs.
