PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to withdraw the entire case in Crime No.275/2023 on the file of the second respondent and hand over the same to any other competent investigating officer within the jurisdictions of the first respondent and further direct the said investigating officer to investigate the case and file a final report within a stipulated time fixed by this Court.

O RDER This petition is filed seeking for a direction to transfer the case in Crime No.275 of 2023 pending on the file of the 2nd respondent to any other investigating officer on the ground that the respondent Police have not been collecting CCTV footage in respect of the alleged offence. 2.It is submitted by the learned counsel for the petitioner that the 3rd respondent, while overtaking another vehicle near Chekkanurani Village in NH 85, hit the petitioner's left side car mirror. Therefore, he made a complaint before the 2nd respondent Police, based on the same, a case has been registered in Crime No.275 of 2023 for the offences punishable under Sections 279 and 337 IPC. It is further submitted that though CCTV footage could be collected, the respondent Police have not collected the same and therefore, sought for transfer of investigation.

3.The learned Government Advocate (Crl.Side) for the respondents submitted that the injured and other witnesses to the accident are very much available and their statement have also been recorded and investigation is being proceeded on proper lines.

4.Considering the facts and circumstances of the case, since the injured and other eye witnesses to the accident are very much available and that the Police have already recorded their statement, this Criminal Original Petition is disposed of with a direction to the respondent Police to complete the investigation within a period of eight weeks from the date of receipt of a copy of this order.
