PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the second and third respondents not to harass the petitioners and their family members for give money sum of Rs.50,000/- to the fourth respondent. O RDER This petition is filed for a direction to the respondent Police not to harass the petitioners and their family members to give a sum of Rs.50,000/- to the 4th respondent.

2.It is submitted by the learned counsel for the petitioners that basing on the complaint given by the 4th respondent, the respondent Police have called the petitioners for enquiry and during the course of enquiry, the 1st petitioner has given an undertaking that he would return back the jewels to the 4th respondent, accordingly, by recording the same, the complaint of the 4th respondent was closed. It is submitted that thereafter, the respondent Police have started harassing the petitioners to give a sum of Rs.50,000/- (Rupees Fifty Thousand Only) to the 4th respondent. It is further submitted that as per the undertaking given by the 1st petitioner, the jewels were returned back to the 4th respondent and he has not agreed to give a sum of Rs.50,000/-. The petitioners have also given a complaint to the 1st respondent on 05.09.2023, wherein no action has been taken so far.

3.The learned Government Advocate (Crl.Side) for the respondents 1 to 3 submitted that as of now, no case and no enquiry is pending against the 2/4

petitioners. The allegation of the petitioners that the 3rd respondent is harassing the petitioners is also incorrect.

4.Considering the submissions made on both sides, since the enquiry has already been closed and no case is pending against the petitioners, this Criminal Original Petition is disposed of with a direction to the respondent Police, in case if the petitioners' presence is required, to follow the procedure established under law scrupulously.
