JUDGMENT

(Judgment of the Court was made by S.M.SUBRAMANIAM, J.) The Writ Court in the impugned order considered the issues on merits. The lease granted in favour of the appellant was terminated since the appellant failed to clear the arrears of lease amount, pursuant to the lease executed.

2. The learned counsel for the respondent would submit that the lease was terminated pursuant to the orders of the Hon'ble Division Bench of this Court in W.A(MD)No.637 of 2024, dated 10.04.2024. The learned Single Judge, however, granted liberty to the appellant to participate in the fresh auction. It is brought to the notice of this Court that fresh auction process has already been commenced and in midway. Thus, the appellant may participate, if he is otherwise eligible as per the tender conditions.

3. With these observations, the Writ Appeal stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed. (S.M.S., J.) & (G.A.M., J.) 20.08.2025 NCC : Yes / No Index : Yes / No am To The Joint Commissioner, HR & CE Department, Thanjavur.
