O R D E R

This writ petition has been filed for issuance of a writ of Mandamus, directing the respondents to release the monthly salary from 01.01.2025 to 30.06.2025 and to settle the retirement benefits of Provident fund, Death Cum Retirement Gratuity (DCRG), Special Provident Fund, Earned Leave Surrender including monthly pension and other entitled retirement benefits by considering her representation dated 04.08.2025.

2.Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. Having regard to the nature of the order proposed to be passed in this writ petition, notice to the respondents 3 and 4 is dispensed with. 2/6

3. The learned counsel for the petitioner submits that the petitioner was initially appointed as a Secondary Grade Teacher on 10.06.1996 in the third respondent school. The grievance of the petitioner is that although she attained the age of superannuation on 30.06.2025, her pension proposal has not been forwarded to the Accountant General by the second respondent till date. In this regard, she submitted a detailed representation dated 04.08.2025, requesting the settlement of her retirement benefits. As no action was taken on the representation, the petitioners have filed the present writ petition before this Court.

4. Learned counsel for the petitioner would further submit that the petitioner would be satisfied if a direction is issued to the second respondent to consider the representation of the petitioner dated 04.08.2025 and pass appropriate orders thereon, within a time frame to be fixed by this Court.

5. Considering the above facts and circumstances, without going into the merits of the case, this Writ Petition is disposed of with a direction to the 3/6

second respondent, to consider the representation of the petitioner dated 04.08.2025 and pass appropriate orders in accordance with law. Such exercise shall be completed as expeditiously as possible, preferably within a period of four

(4) weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the second respondent to consider the same on its own merits. No costs.
