O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to restore the name of Nallusamy, S/o. Kunnama Reddiyar, in the Revenue Records relating to T.S.No.39, Ward-D, Block No.0004 and T.S.No.65, Ward-D, Block No.0004, by removing the name of the third respondent, based on the petitioner's representations dated 23.06.2022 and 25.10.2022 submitted to the first and second respondents.
2. The case of the petitioner is that the subject property belongs to the petitioner, who inherited the same under a registered Will dated 04.08.2009 executed by one Ejjammal, W/o. Nallusamy. The third respondent, by committing fraud on the second respondent, changed the name in respect of the subject property from Nallusamy to his own name in the Town Survey Register. After coming to know of the same, the petitioner sent a representation dated 23.06.2022 to the second respondent seeking restoration of the name of Nallusamy in the Town Survey Register.

Since the second respondent did not take any steps to consider the petitioner's request, the petitioner sent a further representation dated 25.10.2022 to the first respondent, who in turn directed the second respondent to enquire into the matter. The second respondent called the petitioner for an enquiry on 28.03.2023. The petitioner appeared and submitted the relevant documents. The third respondent also appeared and stated that he had filed a suit in O.S.No.77 of 2023 on the file of the District Judge, Tiruchirappalli, which is pending. The said suit was filed after the representations made by the petitioner.
4. The second respondent, without considering the petitioner's representations, delayed the enquiry in collusion with the third respondent, enabling the third respondent to file the suit. Despite being fully aware of these facts, the first and second respondents have neither considered the petitioner's request nor disposed of his representations.
5. The learned Additional Government Pleader appearing for the first and second respondents would submit that the enquiry has already been conducted pursuant to the petitioner's representation; and that the Page No. 3 of 6
petitioner's representations would be disposed of within a period of twelve weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to dispose of the petitioner's representations dated 23.06.2022 and 25.10.2022 on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. Before passing any order, the first respondent shall provide a reasonable opportunity of hearing to the petitioner as well as to the third respondent and any other interested parties who may be affected by the decision. It is needless to state that while disposing of the representations, the filing of the civil suit shall be taken into consideration. There shall be no order as to costs.
