O R D E R

This Criminal Original Petition has been filed to direct the first respondent to withdraw the investigation in Crime No.1 of 2019, dated 02.03.2019 from the third respondent and entrust the same to any other competent investigation officer.

2. The petitioner is a accused and therefore, he cannot choose the investigation agency. Hence, the prayer sought for by the petitioner cannot be granted and the Criminal Original Petition is liable to be dismissed.

3. The learned counsel appearing for the petitioner submitted that the petitioner wants to settle the amount to the victim.

4. The learned Additional Public Prosecutor appearing for the respondents submitted that there are 440 depositors/victim and the https://hcservices.ecourts.gov.in/hcservices/ 1/2

petitioner has collected approximately a sum of Rs.2,34,500/-from the depositors.

5. Considering the facts and circumstances, the petitioner is directed to appear before the third respondent and on his appearance, the third respondent is directed to furnish details of depositors.

6. With the above directions, the Criminal Original Petition is dismissed.
