For Respondent : Mr.M.Vaikkam Karunanithi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.10 of 2019 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/sole Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 406, 498(A) IPC and Section 4 of Tamil Nadu Harassment of Women Act, in Crime No.10 of 2019, seeks anticipatory bail. 2.It is submitted by the learned Government Advocate (Crl.Side) that the petitioner has filed this petition, only against the warrant issued by the trial Court in C.C.No.76 of 2020. Before the trial Court, due to absence of the petitioner, absconding charge sheet has been filed by the respondent police. 3.Since, it is a matrimonial dispute between the parties, the petitioner can approach the trial Court to recall the warrant issued against him, with proper request.

4.At this stage, the question of anticipatory bail does not arise. The trial Court may consider the request of the petitioner, since it is a matrimonial dispute between the parties, by following the guideliness issued by Hon'ble Supreme Court in Satendar Kumar Anil Vs CBI & Others, in S.L.P.No.5191 of 2021 dated 07.10.2021. https://hcservices.ecourts.gov.in/hcservices/ 1/2
