PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents herein to give permission to conduct Vinayagar Sathurthi festival by erecting Vinayagar Statue in front of the Mottaiiyan Kovil situated at Harihara Vinayagar Kovil Street as stated in the representation of the petitioner, dated 24.07.2025 given to the respondents 1 to 3. Further, the Vinayagar Sathurti festival proceedings is scheduled from 26.08.2025 to 28.08.2025. 1/5

Seeking permission to conduct Vinayagar Chathurthi festival by erecting Vinayagar Statue in front of Mottaiiyan Kovil, situated at Harihara Vinayagar Kovil Street, the petitioner has submitted a representation before the respondent police and filed this writ petition.
2. Mr.F.Deepak, learned Special Government Pleader takes notice for the first respondent. Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the respondents 2 & 3 and submits that request of this petitioner has already been considered and it was rejected by the Sub Collector, vide his proceedings in Na.Ka.No.A1/230/2025/TKS(004), dated 19.08.2025. A copy of the rejection order is also placed before this Court.

3.In reply, the learned counsel for the petitioner submits that the competent authority to reject the request of the petitioner for erecting Vinayagar idol is the Revenue Divisional Officer. He further submits that they have not received any rejection order from the Sub Collector, as stated by the respondent police. 4.The learned Additional Public Prosecutor submits that apprehending law and order problem, a report consisting the particulars of cases registered on the incidents that took place in the year 2023, during Vinayagar Chaturti festival in that locality has been submitted to the Sub Collector, Tenkasi, based on which, the Sub Collector has passed the above rejection order. 5.Recording the submissions of the learned Additional Public Prosecutor and the proceedings of the Sub Collector, Tenkasi, dated 19.08.2025, this writ petition is closed with a direction to the respondent police to furnish copies of report of the respondent police and the proceedings of the Sub Collector to the petitioner. petitioner is at liberty to challenge the same in the manner known to law. No costs.
