Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents to consider the representation, dated 4.9.2018 on merits and in accordance with law within the time frame fixed by this Court and direct the second respondent to sanction the old age pension and arrears of old age pension with effect from 2016 to 2018.

ORDER

The Petitioner has filed this Writ Petition seeking issuance of a Writ of Mandamus directing the respondents to consider the representation dated 4.9.2018 on merits and in accordance with law within the time

frame fixed by this Court and direct the second respondent to sanction the old age pension and arrears of old age pension with effect from 2016 to 2018.

2.Heard the learned counsel appearing on either side and perused the materials placed before this Court.

3.The case of the Petitioner is that the Petitioner is a senior citizen and was getting old age pension at Rs.1000/- p.m. from 1.11.2012 to 2016 from the Tahsildar, Tenkasi Social Security Old Age Pension Scheme and thereafter, without assigning any reason, the same was stoped in the year 2012. Again on representation being made, the respondents continued to pay the old age pension from November 2012. But the respondents have not given the arrears old age pension from 2016 to 2018. In this connection, the Petitioner made a representation on 4.9.2018 to the respondents seeking old age pension and arrears of old age pension from 2016 to 2018. Since the same was not considered till date, the Petitioner has filed this Writ Petition for the relief stated supra. 4.The learned Government Advocate appearing for the respondents 1 and 2 would submit that the Petitioner's representation for old age pension and arrears thereof will be considered by the respondents in accordance with law, within the time limit prescribed by this Court.

5.In view of the above submission, this Court, without going into the merits of the matter, directs the respondents to consider the representation of the Petitioner, dated 4.9.2018 for old age pension and arrears thereof and pass appropriate orders, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

6.With the above directions, the Writ Petition stands disposed of. No costs.
