ORDER : The Court made the following order :- The petitioner/ Accused who apprehends arrest at the hands of the respondent police for the offences under Sections 177, 419, 468, 471 of IPC and Section 24(1) of Cigarette and Other Tobacco Products Act, 2003 in Crime No. 30 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused persons were found in illegal possession of 1035 packets of banned Tobacco products. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent, he has been falsely implicated in this case. He has not committed any offence as alleged by the prosecution. Only based on the confession of the coaccused the petitioner has been implicated in this case.

4. Learned Government Advocate (Crl.side) would submit that the earlier application was dismissed by this Court on the ground that the petitioner must be subjected to custodial interrogation.

5. Considering the gravity of the offences , the earlier application was dismissed. No change in circumstances. The petitioner must undergo custodial interrogation who created fake passport.
