PRAYER :- For Bail in Crime No.30 of 2021 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/A.1, who was arrested and remanded to judicial custody on 11.11.2021 for the offences punishable under Sections 406 and 420 IPC, in Crime No.30 of 2021, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the accused persons had promised to secure a job for the de-facto complainant and received Rs.1,60,000/- each from the de-facto complainant and victim and later, they cheated. Hence, the complaint.

3.When the matter is taken up for hearing today, the learned Additional Public Prosecutor would submit that it is a clear case of job racketing and that the petitioner has received Rs.3,20,000/- from the de-facto complainant and victim. 4.The learned counsel for the petitioner would submit that he has paid Rs.20,000/- and he is not in a position to pay the remaining amount.

CRL OP(MD). No.20202 of 2021 5.Since the petitioner has expressed his readiness and willingness to settle the issue and also considering the period of incarceration, this Court has granted interim bail to the petitioner for a period of two months vide order dated 17.12.2021. But admittedly, the petitioner has not chosen to settle the amount as agreed by him.

6.Considering the seriousness and gravity of the offence alleged and also the quantum of amount involved and also the fact the petitioner has not chosen to pay the amount as agreed by him, this Court is not inclined to grant bail to the petitioner. 7.Accordingly, this Criminal Original Petition is dismissed. sd/- 04/04/2022 / TRUE COPY / / /2022 Sub-Assistant Registrar (C.S.)
