PRAYER :- Writ Petition, filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the 3rd respondent to comply the order passed by the 1st respondent vide his proceeding in Na.ka.No.6774/2019 dated 08.11.2023 to conduct resurvey in the respective survey nos. 51/7A, 51/7B1, 51/7B2, 51/7B3, 51/8A1 and 51/8A2 based on the parent documents of both parties within stipulated time period fixed by this Court.

O R D E R

This writ petition has been filed seeking a direction to the 3rd respondent to comply the order passed by the 1st respondent vide his proceeding in Na.ka.No.6774/2019 dated 08.11.2023 to conduct resurvey in the respective survey nos. 51/7A, 51/7B1, 51/7B2, 51/7B3, 51/8A1 and 51/8A2 based on the parent documents of both parties within stipulated time period fixed by this Court.

2. Heard the learned counsel for the petitioner and learned Government Advocate for the respondents 1 to 4.

3. The learned counsel for the petitioner would submit that seeking to conduct survey, a representation has been sent to the respondents on 2/5

09.02.2024. However, the said representation has not been acted upon

4. Learned Additional Government Pleader would submit that the representation of the petitioner would be considered and appropriate orders would be passed.

5. In view of the above submissions, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the 3rd respondent to consider the representation of the petitioner dated 09.02.2024 for conducting survey and pass appropriate orders on merits and in accordance with law after conducting enquiry and by hearing all the parties along with their objections, if any. The said exercise shall be completed within a period of 12 weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
