PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.91 of 2023 on the file of the Respondent police. ORDER : The Court made the following order :- The petitioners/Accused No.5, apprehending arrest at the hands of the 1/4

respondent Police for the alleged offence punishable under Sections 147, 341, 294(b), 307, 109 I.P.C., in Crime No.91 of 2023 on the file of the respondent Police, seek anticipatory bail.

2. The case of the prosecution is that the defacto complainant and her husband were hailing from Thoothukudi district and are residing in N.Mettupatti village. The accused persons warned the defacto complainant not to talk with the natives people. But, the husband of the defacto complainant had good relationship with all the persons. On 31.08.2023 at about 7.00 a.m., the accused persons way laid the defacto complainant's husband near Nenmeni bridge, abused him using filthy language and also attacked him using knife. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioners is an innocent and he has been falsely implicated in this case. It is a case and counter case and the counter case has been registered in Crime No.92 of 2023. Further, injured has been discharged from the hospital.

4. The learned Additional Public Prosecutor for the respondent Police submitted that even though the injured is discharged from the Government hospital, 2/4

now he is admitted in private hospital.

5. Considering the fact and circumstances of this case and considering that injured is still in hospital, this Court is not inclined to grant anticipatory bail to the petitioner.
