The above petition has been filed seeking orders to condone the delay of 117 days in filing the second appeal, challenging the judgment and decree passed in A.S.No.26 of 2023 dated 12.12.2024 on the file of the Additional Subordinate Court, Kumbakonam, confirming the judgment and decree made in O.S.No.32 of 2019 dated 31.03.2023 on the file of the District Munsif cum Judicial Magistrate, Thiruvidaimaruthur.

2. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondents.

3. The learned counsel appearing for the respondents would submit that they are having objections to condone the delay.

4. Considering the reasons assigned and also the quantum of delay, this Court is inclined to condone the delay.

Accordingly, this petition is ordered and the Registry is directed to number the second appeal, if it is otherwise in order and list it for admission in the usual course.
