Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the first respondent to expedite the petition given by the petitioners under the Maintenance of the Welfare of Parents and Senior Citizens Act, 2007 pending on the file of the first respondent in Na.Ka.No.A5/8233/2021 and to dispose of the same within a time frame that may be fixed by this Court.

ORDER

Mr.D.Ghandiraj, learned Special Government Pleader, takes notice for first the respondents.

2.The petitioners herein/Senior Citizens had given an application before the first respondent under the Maintenance of the Welfare of Parents and Senior Citizens Act, 2007. The said petition is pending before the first respondent. Notice had also been directed to the parties including the petitioners and also the second respondent. It is complained by the learned counsel for the petitioners that the second respondent did not appear for the enquiry and therefore, the first respondent has adjourned the matter.

3.A direction is given to the first respondent to proceed in the manner known to law, issue sufficient notice and take further steps keeping in mind the necessities of the petitioners herein in approaching him seeking relief. I hope that necessary orders should be passed on or before 28.02.2022 and enquiry is concluded. https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.22510 of 2021 4.It is stated that the first respondent actually has an office at Aruppukottai, Virudhunagar District and not at Sivakasi Town, Virudhunagar District as given in the cause title. A short amendment is suo-motu made in the cause title by mentioning that the name of the Office is not Sivakasi Town, Virudhunagar District, but Aruppukottai, Virudhunagar District, so far as the first respondent is concerned. Before the order copy is issued, necessary amendment may also be carried out. 5.In view of the nature of the order passed, directing the first respondent to conduct enquiry and pass orders, notice is not directed to the second respondent.

6.With the above observations, the Writ Petition is disposed of. No costs.
