Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to expedite an Appeal in Na.Ka.No.D3.5701/2010 on the file of the first respondent and pass orders within the time stipulated by this Court.

ORDER

In view of the nature of the order passed, I am not issuing notice to the second respondent. Heard Mr.S.Poornachandran, learned counsel for the petitioner and Mr.S.Kameswaran, learned Government Advocate who takes notice for the first respondent.

2. It is stated that an appeal in Na.Ka.No.D3.5701/2010 is pending on the file of the first respondent from the year 2010. The appeal was originally preferred by the father of the petitioner, Rengasaamy. Thereafter, pending the appeal, he died. This necessitated impleading the legal heirs. That procedure has been completed. Now the second respondent had also joined in the appeal and had filed objections.

3. There is a duty cast on the first respondent to examine the appeal papers on merits and pass necessary orders. In view of the fact that it is pending for more than 10 years, a direction is issued to the first respondent / the District Revenue Officer, Pudukottai District to dispose of the aforesaid appeal on or before 31.01.2022.

4. With the said observations, this Writ Petition is disposed of. There shall be no order as to costs.
