O R D E R

This writ petition has been filed for issuance of a writ of Mandamus, directing the respondent to provide the petitioner with permanent suitable alternative employment in accordance with his medical condition and to refer him to the Medical Board for determining his fitness and suitability for light duty, with pay protection, continuity of service, back wages and all other attendant benefits, in accordance with Section 47 (1) of the persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. 2.Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel for the petitioner submits that the petitioner appointed as an Assistant Tradesman in the respondent Corporation from 2013 at Sekkanurani Branch. While he was in service, on 28.04.2022, he fell ill and was rushed to the hospital and where he was subsequently diagnosed with a hernia. He has now become permanently disabled. In this regard, the petitioner submitted a representation dated 20.06.2025, requesting that he may referred to Medical Board to assess his medical fitness. However, the said representation is still pending consideration before the respondent. Hence, the petitioner has filed the present Writ Petition before this Court.

4. Learned counsel for the petitioner would further submit that the petitioner would be satisfied if a direction is issued to the respondent to consider the representation of the petitioner dated 20.06.2025 and pass appropriate orders thereon, within a time frame to be fixed by this Court.

5. Considering the above facts and circumstances, without going into the merits of the case, this Writ Petition is disposed of with a direction to the 3/6

respondent, to consider the representation of the petitioner dated 20.06.2025 and pass appropriate orders in accordance with law, after affording an opportunity of hearing. Such exercise shall be completed as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondent to consider the same on its own merits. No costs. Consequently, the connected miscellaneous petition is closed.
