Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents 1 to 3 herein to disburse the family pension to the petitioner within a stipulated time.

O R D E R

The instant writ petition has been filed seeking a direction to the respondents 1 to 3 herein to disburse the family pension to the petitioner within a stipulated time.

2.Learned Counsel for the petitioner would submit that the petitioner's husband was working as Health Worker at Narikalpatti Government Primary Health Centre, Palani Taluk, Dindigul District and he retired from service on 28.02.2018, on superannuation. Thereafter, he 2/6

died on 07.05.2021. After the death of her husband, the petitioner filed an application for family pension by way of representation dated 27.02.2025. Till date, no orders have been passed in the said representation. Hence, the present Writ Petition. 3.Learned Counsel for the petitioner would further submit that this Court may issue a direction to the respondents to consider the representation of the petitioner.

4.Per contra, learned Counsel for the first respondent would submit that as on date, the petitioner has not filed any representation to the second respondent enabling the second respondent to forward the same to the first respondent for consideration. Though the first respondent received the representation from the petitioner, however Form-14 was not submitted along with the required documents. If the petitioner submits a fresh representation along with required documents before the second respondent, this Court may issue a direction to forward the same to the first respondent and within twenty days family pension will be granted. 3/6

5.Considering the limited scope of the relief sought for by the petitioner, there shall be a direction to the petitioner to submit a fresh representation to the second respondent along with Form-14 and other relevant documents within a period of two [2] weeks from the date of receipt of a copy of this order. On receipt of such representation from the petitioner, the second respondent is directed to forward the same to the first respondent, who shall consider and dispose of the same on merits within a period of three [3] weeks thereafter. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondents to consider the same on its own merits.

6.With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs.
