Prayer : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 4 to remove the encroachment made by the 5th respondent, who is a Village Administrative Officer by erecting cement wall causing hindrance to the Street Pathway existing in front of the Survey Nos.267/36 and 267/47 of Nagalapuram Village, Vilathikulam Taluk, Thoothukudi District, forthwith. ORDER

(Order of the Court was made by R.SUBRAMANIAN, J.) Mr.S.R.A.Ramachandran, learned Additional Government Pleader, would submit that the land in Survey No.267/46 has been classified as ''Lane''. He would also state that on receipt of the petitioner's representation, steps have been taken to survey the land in question and also remove the encroachments, if any found over the said land.

2. The statement of the learned Additional Government Pleader is recorded and the Writ Petition is dismissed with liberty to the petitioner to seek re-opening of the Writ Petition, if action is not taken in accordance with law. No costs.
