ORDER

The Writ Petition is filed seeking a direction to the third respondent to consider the appeal preferred by the petitioner, dated 21.07.2025 and dispose of the same in accordance with law.

2. Heard the arguments of Mr.D.Shanmugaraja Sethupathi, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader, who takes notice for the respondents 1 to 4.

3. Since no adverse order is passed against the fifth respondent, notice to the third respondent is dispensed with.

4. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

5.According to the petitioner, the housing plot situated in S.No.1394/32 and the agricultural land situated in S.No.1403/2 in Mulaikaraipatty, Nanguneri Taluk, Tirunelveli District, was originally assigned in favour of the petitioner's father under the Tamil Nadu Government Scheme for Rehabilitation of Sri Lanka refugees. After the death of the petitioner's father, the patta was wrongly issued in favour of the petitioner's brother fifth respondent exclusively. Therefore, the petitioner submitted an appeal before the third respondent on 21.07.2025 and the same has not been taken on file till date. Therefore, the petitioner has come before this Court.

6.The learned Additional Government Pleader, who takes notice for the respondents 1 to 4 would submit that the appeal preferred by the petitioner will be considered in accordance with law within the time stipulated by this Court.

7. In view of the same, without expressing any opinion on the merits of the matter, the third respondent is directed to consider the appeal filed by the petitioner, dated 21.07.2025 and pass final orders on its own merits within a period of twelve weeks from the date of receipt of cop of this order, after issuing notice to the petitioner, fifth respondent and other interested parties.

8. With the above direction, this Writ Petition is disposed of. No costs.
