The present Writ Petition has been filed for a Mandamus, to direct the respondents to restore the petitioner's license based on the award passed by the Hon'ble Arbitrator in Award No.57 dated 01.10.2019 declaring the termination as bad in law. 2/5

2.A perusal of the averments and the records shows that the termination has been declared as bad. Hence, the right course available to the petitioner for restoration of the petitioner's license is to file an Execution Petition before the execution court. 3.Learned Counsel for the respondents would submit that even the arbitration award says that the license need not be restored. However, learned Counsel for the petitioner submits that arbitration award does not speak about restoration of the petitioner's license, though it has declared the termination as bad in law.

4.Therefore, this Court is of the considered view that if the petitioner is having any right based on the arbitration award passed in Award No.57 dated 01.10.2019, the petitioner shall file an Execution Petition before the Execution Court and execute the award.
