ORDER
The Writ Petition is filed seeking a direction to the respondents to survey the property situated in S.No.12/2B2 in Patta No.822 measuring 78 cents situated at Keeripatti Village, Usilampatti Taluk, Madurai District, by considering the petitioner's representation, dated 23.07.2025.
2. Heard the arguments of Mr.R.Dinesh Babu, learned counsel appearing for the petitioner; Mrs.Jeya Priya, learned Government Advocate, who takes notice for the respondents 1 and 2 and Mr.M.Vaikkam Karunanithi, learned Government Advocate (Criminal Side), who takes notice for the third respondent.
3. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
4. The petitioner claims right over the subject property under settlement deed executed by her husband, dated 13.03.2012. The patta for the subject property stands in the name of the petitioner in Patta No.822. He submitted an application on 28.12.2023, seeking survey of the subject property. The same has not been considered. Hence, he has come before this Court.
5.The learned Government Advocate, who takes notice for the respondents 1 and 2 would submit that the petitioner has not filed proper online application and acknowledgment for having submitted the application.
6. In view of the same, without expressing any opinion on the merits of the matter, the petitioner is directed to produce the acknowledgement for submitting the online application before the first respondent within a period of two weeks from the date of receipt of a copy of this order. On such production of acknowledgment, the first respondent shall consider the application of the petitioner and pass final
orders on its own merits, within a period of eight weeks from the date of receipt of the acknowledgement, after issuing notice to the petitioner, neighboring land owners and other interested parties.
7. With the above direction, this Writ Petition is disposed of. No costs.
