2. In view of the above, the Writ Petition stands dismissed as withdrawn. No costs. Liberty is granted to the petitioner to approach the competent Civil Court for recovery of money and the period pending before this Court is excluded for the purpose of limitation. Consequently, connected miscellaneous petition is closed.
