ORDER
The Petitioner has prayed for issuance of a Writ of Mandamus forbearing the respondents to allow the Petitioner to participate in the tender as per notification in Na.Ka.No.P2/2616/2022, dated 11.10.2022.
2.Mr.D.Sadiq Raja, learned Additional Government Pleader takes notice for the first respondent and Mr.D.S.Nedunchezhian, learned Government Advocate takes notice for the second respondent.. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3.The case of the Petitioner is that the Petitioner is a registered contractor and that the second respondent in his tender notification as stated above has informed the public that the tender will be received upto 3.00 p.m. on 11.10.2022 for the works like constructing of culverts, retaining walls in Government Road to construct new road. The respondent concerned made favour in respect of some persons floating the transparency and as such, the Petitioner's right in participating the tender process is affected and the second respondent has also made all efforts preventing the Petitioner from participating in the tender process. Hence the Petitioner has filed the above Writ Petition for the relief stated supra.
4.The learned Additional Government Pleader appearing for the first respondent produced a communication of the Block Development Officer, Elayangudi in Na.Ka.Pi.2/2616/2022, dated 19.10.2022 and submitted that the tender notification, dated 20.10.2022 and 21.10.2022 have been stopped due to some administrative reasons and the same is adjourned
sine die. It is further stated that the Petitioner will be permitted to participate in the future tender, if any, notified by the authotities. 5.In view of the above submission, the Writ petition stands disposed of. No costs.
