PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 & 2 to survey the petitioner's land bearing Survey No.648/8 situated at Velvaarkottai Village, Vedasadur Taluk, Dindigul District and fix the four boundaries as per revenue records with adequate police protection of 3rd respondent based on the petitioners application dated 26.07.2023 within time limit fixed by this Court.

O R D E R

The petitioner with a grievance that his application for survey of his land has not been considered has filed this writ petition for a Mandamus to direct the respondents 1 & 2 to survey the petitioner's land.

2.Mrs.D.Farjana Ghoushia, learned Special Government Pleader, who takes notice for the respondents 1 & 2 submits that based on the application of the petitioner, they were about to conduct the survey, however, the petitioner has raised objections that he has already approached this Court and on receipt of an order from this Court, the survey can be carried out. Hence, they have not conducted the survey as scheduled.

3.Considering the submission made by the Special Government Pleader, this writ petition is disposed of with a direction to the respondents to conduct an enquiry under Section 10 of the Tamil Nadu Survey and Boundaries Act, 1923 after issuing notice to the adjacent land owners and conclude the survey within a period of four weeks from the date of receipt of a copy of this order.
