For Respondent : Mr.S.Prakash Government Advocate (Crl.Side) PETITION FOR MODIFICATION Under Sec.528 of BNSS PRAYER :- To modify the condition No.6(c) imposed in Crl.OP(MD).No.9337 of 2025 dated 05.06.2025.

ORDER : The Court Made the following order :- This petition has been filed to modify the condition No.6(c) imposed in Crl.OP (MD).No.9337 of 2025 dated 05.06.2025.

2. The learned counsel for the petitioners would submit that the petitioners have filed an anticipatory bail application before this Court on 03.06.2025 in Crl.OP. (MD).No.9337 of 2025. The said anticipatory bail petition was heard and on 05.06.2025, this Hon'ble Court was pleased to grant anticipatory bail to the petitioners with certain conditions. In the said bail order, Condition No.6(c) as follows:

''(c). The petitioner shall report before the respondent police daily at 10.30.a.m. until further orders.''

3. He further submits that these petitioners complying the said condition from 02.08.2025 without any fail. At the time of the petitioners appeared before the respondent police, they were unnecessarily hold by the respondent police upto afternoon without any reasons. The respondent police harassed the petitioner and hold them at the police station without any valid reasons. The petitioners are apprehended that the respondent police will continuously harassed and committed human rights violations as against the petitioners. Therefore, the petitioner seek indulgence of this court by modifying the said condition imposed against them. 2/4

Hence, he prays for modification of the said condition.

4. The learned Government Advocate (Crl.side) appearing for the respondent would submit that the respondent police has not harassed the petitioners. However, he has not raised any objection to allow this Criminal Miscellaneous Petition.

5. Considering the submissions made by the learned Counsel for the Petitioner and being satisfied with the reasons stated above, this Court is inclined to modify the Condition No.6(c) in the order made in Crl.O.P(MD).No.9337 of 2025 dated 05.06.2025. Accordingly, Condition No.6(c) is modified as ''(c). The petitioners shall appear and sign before the learned Judicial Magistrate No.III, Tirunelveli on every working day at 10.00a.m until further orders.''. The other conditions shall remain unaltered.

6. With the above said modification, this Criminal Miscellaneous Petition is allowed.
