ORDER

This Writ Petition is filed under Article 226 of the Constitution of India seeking for a Mandamus directing the respondent police to consider the representations of the petitioner dated 27.07.2023 and 28.07.2023. 2.It is submitted that there are disputes between the petitioner and the unofficial respondent Nos.3 to 8 in respect of immovable property. The petitioner by paying the requisite fee got the land surveyed and survey stones were also fixed by the Revenue Authorities. However, the unofficial respondent Nos.3 to 8 have trespassed into the land and broken the boundary stones, thereby the complaints were given on 27.07.2023 and 28.07.2023. However, no action has been taken. It is submitted further that one Police Constable has taken videograph when the offence was committed.

3.The learned Government Advocate (Crl.side) submits that both the complaints of the petitioner were received and an enquiry is being initiated. It is 2/5

pending on account of the fact that the petitioner is not cooperating with the enquiry. The learned Government Advocate (Crl.side) after taking instructions from the respondent police, who is present before this Court, has reported that the police have not taken any videograph as alleged by the petitioner while the offence is being committed by the unofficial respondent Nos.3 to 8. 4.Considering the submissions made by the learned counsel on either side and on perusal of the records, this Petition is disposed of directing the petitioner to appear before the respondent police on 19.09.2023, on which the respondent police are directed to complete the enquiry as expeditiously as possible, not later than two weeks from the date of receipt of a copy of this order.
