ORDER

Mr.R.Senthil Kumar, learned Central Government Standing Counsel takes notice for the first respondent and Mr.Vaikkam Karunanidhi, learned Government Advocate (Crl.side) takes notice for the second respondent. 2.In this writ petition, the petitioner has prayed for a Mandamus to direct the first respondent to renew the petitioner's passport, by considering the petitioner's application in Application No. TR2075224851425, dated 23.06.2025. 3.The learned Government Advocate (Crl.side) for the second respondent submits that the petitioner is the first accused in Crime No.635 of 2020 registered on 06.08.2020 for the offences under Sections 294(b), 323, 431 and 506(2) IPC and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002. 2/5

4.It is submitted that although a charge sheet was made ready as early as on 03.08.2021, it has not been filed as on date before the Additional Mahila Court, Pudukkottai.

5.Since no case is pending before any Court, there can be no impediment in terms of Section 16(2)(f)of the Passports Act, 1967. Therefore, there shall be a direction to the first respondent to process the passport application, dated 23.06.2025, of the petitioner bearing passport Application No.TR2075224851425 within a period of six weeks from the date of receipt of a copy of this order. 6.It is made clear that in case the charge sheet is taken on file by the Additional Mahila Court, Pudukkottai in future, the petitioner shall voluntarily surrender the passport before the Additional Mahila Court, Pudukkottai or any other Court, to which the case may be transferred to. 7.In case, the petitioner fails to comply with the same, it is for the second respondent to take steps to seize the passport from the hands of the petitioner and produce the same to the concerned Court, in which case, the petitioner is at liberty 3/5

to move appropriate application for retrieving the same and may file suitable application for appropriate orders for retrieving the same before travelling abroad. 8.With the aforesaid directions, the Writ Petition stands disposed of. No costs.
