ORDER : This Court made the following order :- The petitioner / Sole Accused, who was arrested and remanded to judicial 1/6

custody on 23.07.2025 for the offences punishable under Sections 296(b), 232(1) and 351(2) of the Bharathiya Nyaya Sanhita (BNS), 2023, in Crime No.153 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the defacto complainant is the wife of the petitioner. Due to some matrimonial disputes, the petitioner had earlier murdered the father of the defacto complainant. Therefore, a case was registered and final report has been filed. At this stage, on 19.07.2025, the petitioner has threatened the defacto complainant and other witnesses not to give evidence against him, in the pending trial case,. Therefore, a complaint was given on 23.07.2025 and the case was registered. Hence the petition.

3. The learned counsel for the petitioner would submit that respondent police has lodged a false complaint against this petitioner. The petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. The petitioner is ready and willing to abide any conditions that may be imposed by this Court. He would further submit that the petitioner is in custody from 23.07.2025 for nearly 42 days. Hence, he seeks bail.

4. The learned Government Advocate (Criminal Side) would submit that the petitioner is an Ex-Army Serviceman, who has an extra marital affairs with some other woman, which was questioned by the parents of the defacto complainant. In 2/6

this dispute, the petitioner shot the father of the defacto complainant with his gun. Therefore a case was registered in Crime No.479 of 2022 and the same is pending trial in S.C.No.44 of 2023 before the EC Court, Pudukkottai. The next hearing of the said case is on 01.09.2025 for framing charges. At this stage, the petitioner threatened the defacto complainant not to give evidence against him. However, he objected to grant bail to the petitioner.

Taking into consideration of the facts and circumstances of the case and also taking note of the fact that the occurrence took place on 19.07.2025 but the complaint was lodged only on 23.07.2025, by this time most of the investigation might have been completed and the petitioner is in custody for the past 42 days as he was remanded into judicial custody on 23.07.2025, this court is inclined to grant bail to the petitioner, subject to the following conditions:

Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, each for a like sum to the satisfaction of learned Judicial Magistrate, Gandharvakottai, Pudukkottai District, and on further conditions that :- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity.

[b] The petitioner shall furnish his residential address and contact number to the learned Judicial Magistrate, Gandharvakottai, Pudukkottai District. If the petitioner changes his residential address, he shall report the same to the learned Judicial Magistrate, Gandharvakottai, Pudukkottai District; [c] the petitioner shall stay at Madurai and sign before the Thideernagar police station, daily twice at 10.00 a.m. and 05.00 p.m., for a period of one month and thereafter, the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders.

[d] the petitioner shall not abscond either during investigation or trial. [e] the petitioner shall not tamper with evidence or witness either during investigation or trial.

[f] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court herself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. 4/6

[g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
