ORDER
This Writ Petition is taken up for hearing at the time of admission with the consent of the learned counsel for the petitioner, the learned Central Government Standing Counsel for the first respondent and the learned Government Advocate (Crl.Side) for the second respondent.
2. This Writ Petition has been filed for a Mandamus to direct the first respondent to issue passport to the petitioner by considering the petitioner's application No. MD1065411629025 dated 04.08.2025.
3. The learned counsel for the petitioner submits that the petitioner is an accused in FIR registered in Crime No.4 of 2025, dated 17.01.2025 for the offences under Sections 8(c) and 20(b)(ii)(A) of NDPS Act, 1985, before the 2/6
Inspector of Police, PEW-Thirumangalam. However, the petitioner has wrongly mentioned the second respondent in the cause title as the Inspector of Police, Tirumangalam Police Station.
4. The learned Government Advocate (Crl.Side) for the second respondent confirms and submits that the case is still under investigation and no charge sheet has been filed.
5. Considering the same, there can be no impediment in directing the first respondent to process the passport application of the petitioner. Therefore, there shall be a direction to the first respondent to process the aforesaid application of the petitioner as expeditiously as possible preferably within a period of four (4) weeks from the date of receipt of a copy of this order.
6. The second respondent in the cause title is suo motu corrected as the Inspector of Police, PEW-Thirumangalam Police Station, Madurai, Madurai District.

It is, however, made clear that in case, during the interregnum, charge sheet is filed against the petitioner before the concerned Court, the petitioner shall surrender the passport before the concerned Court and retrieve the same from the said Court as and when the petitioner desires to travel abroad. Otherwise, as soon as the passport is issued to the petitioner and received by the petitioner, the petitioner shall surrender it with the second respondent and get it release after providing sufficient security to the second respondent in connection with the FIR registered in Crime No.4/2025 dated 17.01.2025.

It is made clear that in case, the petitioner fails to comply with any of the above stipulations, the second respondent is at liberty to seize the passport of the petitioner and deliver it before the concerned Court and it is also open for the first respondent to take steps to cancel the passport to be issued to the petitioner.
9. This Writ Petition is disposed of, with the above observations. No costs. Index : Yes / No 28.08.2025 Internet : Yes / No apd 4/6
