O R D E R
This Criminal Original Petition has been filed to direct the respondents 1 to 3, to give proper police Protection to the petitioner on the basis of the complaint given by the petitioner, dated 15.10.2019.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. side) for the respondent.
3. The learned counsel for the petitioner would submit that the fourth respondent's father was filed a suit in O.S.No.63 of 1992, as against one Chelladurai, who is the grandfather of the petitioner herein, before the learned District Munsif, Periyakulam, for a prayer of declaration and injunction in respect of the property comprised in S.Nos.1803/1, 1803/2 and 1804, situated at Jeyamangalam https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.15976 of 2019 Village. The said suit was dismissed and as against which, the fourth respondent preferred an appeal in A.S.No.84 of 1998 before the learned Additional District Judge, (Fast Track Court No.4), Periyakulam and the appeal was also dismissed. As against which, the fourth respondent has filed a Second Appeal and it is pending before this Court. After the demise of his grandfather and father, now, the Second Appeal is filed against the petitioner herein. While being so, the fourth respondent is disturbing the petitioner's possession and enjoyment of the property.
4. Considering the above facts and circumstances, the third respondent is directed to conduct enquiry on the complaint lodged by the petitioner, dated 15.10.2019, with the fourth respondent, after issuing notice to the fourth respondent, within a period of four weeks from the date of receipt of a copy of this order.
5. With the above direction, this Criminal Original Petition is disposed of.
