Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the 1st and 2nd respondents to take appropriate action against the 3rd respondent based on the complaint dated 16.07.2025 in the light of the dictum laid down by the Hon'ble Supreme Court of India in Lalitakumari vs. Government of Uttar Pradesh and Others reported in (2014) 2 SCC 1 within the time frame fixed by this Court. ORDER
The petitioner has filed this Writ Petition seeking for a direction to the 1st and 2nd respondents to enquire the complaint of the petitioner, dated 16.07.2025 and to take appropriate action against the 3rd respondent.
2. The learned Additional Public Prosecutor, on instructions, would submit that pursuant to the complaint lodged by the petitioner, CSR No.502 of 2025 has been registered and the enquiry will be completed within a period of two weeks.
3. The learned counsel for the third respondent would submit that the allegations in the petitioner's complaint disclose only a civil dispute and that the respondents are interfering in such civil disputes.
4. Admittedly, no FIR has been registered on the basis of the petitioner's complaint so far. The second respondent is directed to conduct the enquiry and complete the same within a period of two weeks from the date of receipt of a copy of this order and if a cognizable offence is made out, to proceed further in accordance with law.
