PRAYER : Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to call for the records pertaining to the impugned FIR in crime No.211/2019 on the file of respondent police and quash the same as far as the petitioner concerned. 1/5

ORDER

This criminal original petition has been filed seeking to quash the FIR in Crime No.211 of 2019 on the file of the 1st Respondent Police. 2.The contention of the petitioners is that based on the complaint lodged by the 2nd respondent, the 1st respondent registered the First Information Report in Crime No.211 of 2019 for the offences punishable under Sections 420 of IPC.

3.When the matter is taken up for hearing, the learned Government Advocate (Crl. Side) would submit that even though the petitioner resigned from Directorship on 22.11.2018, during the course of investigation, it was found that the transaction took place from 2016 to 2018. It is also further reveals that Rs.89,90,211/- was received by the petitioner when he was Director of the Company. He further submitted that so far 208 complaints have been received from the victims. Apart from that the company functioned in more than 10 Districts. It will take 2/5

long time to complete the process of investigation. 4.The learned counsel for the petitioner would submit that the petitioner is ready to co-operate with the respondent herein. During the course of investigation order may be passed not to take any coercive steps against the petitioner. This sort of request cannot be made before this Court. The petitioner can workout his remedy through appropriate process.

5.As submitted by the Government Advocate (Crl. Side) earlier, so far investigation is concerned it will be completed as early as possible. No time limit can be stipulated in view of the facts and circumstances of the case. I find no reason to entertain this petition. This petition deserves to be dismissed.

6.Accordingly, this criminal original petition stands dismissed. Consequently, connected miscellaneous petition is closed. 29.11.2023 3/5
