PRAYER: Petition is filed under Section 482 of Cr.P.C, to transfer the investigation to the 3rd respondent office for conducting fair and impartial investigation in Crime No.396 of 2019 on the file of the respondent No.2.

O R D E R

This petition is filed to transfer the investigation in Crime No.396 of 2019 from the file of the second respondent to another investigating agency.

2.The learned Additional Public Prosecutor would submit that the case has been registered in Crime No.396 of 2019 for the offence under Section 174 of Cr.P.C. Now after investigation revealed the https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.OP[MD]No.15909 of 2019 father of the victim deceased namely the husband of the petitioner herein involved in the crime and he was arrested and remanded to judicial custody.

3.Considering the facts and circumstances of the case, the transfer of investigation cannot be considered at this stage. Hence, this Criminal Original Petition is dismissed. However, the second respondent police is directed to complete the investigation and to file a final report within a period of twelve weeks from the date of receipt of a copy of this order.
