Respondent PRAYER: Petition under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus, directing the respondent to pass an order in the petition, dated 27.08.2015 filed before him by the petitioner filed under Section (14) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, by directing the respondent to take physical possession of secured asset and hand over the same to the petitioner bank.

ORDER
[Order of the Court was made by The Hon'ble CHIEF JUSTICE] This is another matter which has remained pending for a considerable period without the petitioner taking any interest therein.
2.The grievance of the petitioner is that the petitioner's request under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, has not been appropriately dealt with by the concerned official.

W.P.(MD)No.19442 of 2016 3.Section 14 of the Act has undergone some changes since the time the petition was filed. Several orders have been passed, inter alia, by this Court, emphasising the importance of requisite assistance being rendered to an applicant under Section 14 of the Act to enable the securities to be sold so that the money blocked in the system can be unblocked.
4.Since the request in this case had been made more than five years back, no useful purpose could be served in pursuing such request. Accordingly, the earlier request made by the petitioner is deemed to be closed and the petitioner is permitted to carry a fresh request under Section 14 of the Act before an official entitled to receive the same for the relevant application to be dealt with as expeditiously as possible and the requisite assistance granted in accordance with law thereupon. W.P(MD).No.19442 of 2016 is disposed of. There will be no order as to costs.
