ORDER
The petitioner, who is the defacto complainant in Crime No.177 of 2025 on the file of the third respondent Police, has filed this petition seeking a direction to transfer the investigation of the said case to the fourth respondent.
2.The case of the petitioner is that the petitioner's husband obtained a vehicle loan of Rs.45,000/- from a private finance company. According to the petitioner, the installments have been paid properly and they have almost completed the loan and a sum of Rs.6,500/- is balance amount, which is due to be payable to the finance company. The finance company has retained the RC book and other records. In this 2/6
circumstances, for this balance of Rs.6,500/-, the finance company, through their employee, on 28.06.2025, at about 07.00 am., visited the petitioner's house and enquired about the whereabouts of her husband, abused her in filthy language and also slapped her husband and pushed him forcibly. She also claims that they were criminally intimidated. The petitioner's husband was taken to the Government Medical College Hosptial, Karur and from there, he was transferred to Trichy Government Hospital for further treatment. On the complaint of the petitioner, a case in Cr.No.177 of 2025 has been registered as against those two persons, who have assaulted the petitioner and her husband, for the offence under Sections 296(b), 115(2) and 351(2) BNS. According to the petitioner, due to this incident, her husband died on 28.06.
2025 and the respondent Police has not taken any steps to arrest the accused. 3.The learned Additional Public Prosecutor appearing for the respondents fairly submits that the finance company, at whose instance the other accused indulged in the offence, has not been added as accused. 4.Therefore, this Court is of the view that the third respondent has not conducted the investigation in a proper manner.
manner in which this case was dealt with, this Court directs the first respondent to withdraw the case in Cr.No.177 of 2025 and entrust the same to the fourth respondent. The fourth respondent is directed to conduct fair investigation in Cr.No.177 of 2025 and also verify the manner in which the Officials have conducted the investigation.
