PRAYER :- For Bail in Crime No.254 of 2023 on the file of the Respondent Police. 1/4

ORDER : The Court made the following order :- The petitioners/A2 and A4 herein, who were arrested on 20.07.2023 for the alleged offences under Sections 436, 506(ii) of IPC, in Crime No.254 of 2023 on the file of the respondent police, seek bail.

2.The case of the prosecution is that on 19.07.2023 at about 1.35 a.m., some unknown persons criminally conspired together and set fire to the car belongs to the defacto complainant and also threatened him with dire consequences. Hence, the respondent police registered the case.

3.The learned counsel for the petitioner submitted that the petitioners are innocent persons and they were falsely implicated in this case and they have not committed any offence as alleged by the prosecution. The co-accused namely A1 has been released on bail by the Court below.

4.This is the second bail applications filed by the petitioners. Considering the gravity of offence, earlier application has been dismissed by this Court. Now it has been stated that the first accused in this case has been released on bail. 2/4

5.But, the learned Additional Public Prosecutor would submit that the first petitioner is having one previous case and the other petitioners are having no previous cases against them.

6.Now considering the period of incarceration and also considering the fact that the co-accused in this case has been released on bail, this Court is inclined to grant bail to the petitioners with certain conditions. 7.Accordingly, the petitioners are ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.III, Thanjavur and on further condition that the petitioners shall report before the respondent police daily at 10.30 a.m. until further orders. sd/- 14/09/2023 / TRUE COPY / 14 /09/2023 Sub-Assistant Registrar (C.S. ) Madurai Bench of Madras High Court, Madurai - 625 023.
